The trial of the accused killer in the death of Christopher Sim in 2021 has been delayed, again.
Jheidon Serieaux exited the courtroom in downtown Hamilton on Tuesday after lawyers informed the judge that he needed medical assistance.

After much anticipation to hear his defence, Serieux did not reach the stand.
Instead, he attended virtually while in custody — but after court returned from lunch, Serieaux’s counsel informed the judge that he could not continue, as he had suffered a seizure.
The family of the late-victim, Christopher Sim, says they’re not happy with the delays from Serieaux.
Sim’s great-aunt, Connie Mackenzie, told CHCH News that she doesn’t find any of this fair. “I think he should be made to get out of his cell, take the stand and testify. Let’s get this over with.”
Lori Martini, Sim’s cousin added, “He’s joking around, he’s laughing all the time, he won’t come out of his cell, or appear at times. It’s like the judge said, ‘we’re in his hands.’”

Serieaux, 26, is charged with first degree murder and is defending himself in the non-jury trial, one marred with early adjournments due to Serieaux saying he was sick one day, and then refusing to show up to court another.
The accused has also passed up on cross examinations against officers, investigators and forensic experts and video surveillance of the attack and other collected items for forensic analysis which were presented.
The court presented Serieuax’s criminal record, which was said to have 23 convictions from the past and included acts of violence, robbery and assault charges.
However, the defence requested the judge to exclude Serieaux’s criminal rap sheet in the event he testifies, because it lacked relevance to Serieaux’s credibility, which the Crown argued against, instead referring to Serieaux’s character as something he carries during testimony.
Still, the judge ordered the exclusion of some of his convictions.
The trial resumes Wednesday morning.
